These conditions set out the rules and regulations for the use of the HANP website, located at https://hanp.it, owned by the HOST ARTIST NAPLES PROJECT association based in Portici (NA), at Via San Cristoforo 18, postal code 80055, VAT number 09918501215. This website is managed by HOST ARTIST NAPLES PROJECT (hereinafter HANP). HANP provides this website, including all information, tools, services, and selected products available on this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. The following terminology applies to these General Conditions (Terms and Conditions), Shipping and Returns, Privacy Policy, Disclaimer, and all Agreements: "Customer," "Buyer," "You," "Your," and "User" refer to you, the person accessing this website and agreeing to the terms and conditions of the company. "The Company," "We," "Our," "Us," "Me," "I," "Store," “H.A.N.P.,” "HANP," and "www.hanp.it” refer to our Company. "Party" or "Parties" refers to both the Customer and ourselves. All terms refer to the offer, acceptance, and consideration of payment required to undertake the process of providing our assistance to the Customer in the most appropriate manner to fulfill the Customer's needs regarding the supply of products and services stated by the Company, in accordance with and subject to the laws of Italy. The use of the above terms or other words in the singular, plural, capitalized, and/or he/she or they, are considered interchangeable and therefore referring to the same.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service," "Terms," "Service"), including any additional terms or conditions and policies referred to here or available via hyperlinks. These Terms of Service apply to all users of the site, including without limitation, users who are browsers, navigators, suppliers, customers, merchants, content contributors, institutional, governmental, or parastatal entities, and foundations.

You understand that your content (excluding credit card information) may be transferred unencrypted and involve (a) transmissions over various networks, and (b) changes to conform and adapt to the technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of the Service, the use of the Service, access to the Service, or any contact or information on the website through which the Service is provided, without our express written permission. The headings used in this agreement are included for convenience only and will not limit or affect these Terms in any way.

The prices of the Products are those listed on the www.hanp.it website at the time of connection. The prices of our products are subject to change without notice. HANP reserves the right to modify prices in the catalog without prejudice to contracts already concluded before the date of the catalog modification. No price changes will be applied to orders currently being processed.

We reserve the right, at any time, to modify or discontinue the Service (or any part or content of it) without notice at any time. We will not be liable to you or to third parties for any modification, price change, suspension, or discontinuation of the Service.

SECTION 5 - PRODUCTS OR SERVICES

Certain Products or Services may be available exclusively online through the website. Some products or services are unique, others may have limited quantities, and others are made to order; all types of products and services are subject to return or exchange only in accordance with our Refund Policy. Please read our Shipping and Returns Policy (Refund section). We have made every effort to display as accurately as possible the colors and images of our products that appear in the store www.hanp.it. We cannot guarantee that the display of any color or detail on your computer or device monitor will be accurate. HANP delivers a Product to the Customer in accordance with the contract, meaning it matches the description, either by image or written, on the www.hanp.it website. The dimensions are approximate to those indicated on the site and may vary due to physiological changes, due to the stretching of canvases on the frame (framing and cutting), with a margin of +/- 2 cm, printing processes, with a margin of +/- 5%, and minor measurement errors without affecting the price to which they refer. Minor differences in the Product from what is described on the website www.hanp.it cannot be contested. HANP does not provide any guarantee:

(a) if, at the time of contract conclusion, the Customer was aware of the defect in the Product, or could not have ignored it with ordinary diligence, or the lack of conformity arose from instructions or materials provided by the Customer, that is, the files or materials sent for the creation of the product contained errors that HANP could not have recognized;

(b) for delays in delivery, or for defects of conformity, attributable to the carrier, who is responsible for the loss or damage of goods delivered to him for transport, from the time he receives them until the time he delivers them to the customer;

(c) if the lack of conformity is not original, or does not exist at the time of delivery of the Product, but occurred for reasons not attributable to HANP;

(d) if the lack of conformity is known or recognizable by the Customer(s) and/or they accept the Product at the time of delivery or receive it without reservation or without conducting any verification.

We reserve the right, but are not obligated, to limit the sale of our products or services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any product or service we offer. All product descriptions or product prices are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not guarantee that the quality of any products, services, information, or other materials purchased or obtained by you will meet your expectations, nor that any errors in the service will be corrected.

Due to the nature of paintings and works of art, the customer must pay the utmost attention to the proper preservation of these products. Paintings and works of art, in general, should not be touched, scratched, bumped, exposed to chemicals, or subjected to environmental or physical stress such as sudden temperature changes, extreme temperatures, dust, humidity, or pressure. It is the customer's sole responsibility to properly preserve the purchased goods. Any damage, of any nature and extent, whether intentional or accidental, environmental, mechanical, physical, or chemical, caused to the artworks by the customer after delivery and the assumption of the work by the customer, is solely attributed to the buyer. By accepting the Terms and Conditions of this website, www.hanp.it, the customer releases HANP, VAT number 09918501215, from any legal and economic responsibility related to damages to the artworks after delivery to the customer.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, at our sole discretion, limit or cancel quantities purchased per person, per family, or per order. These restrictions may include orders placed by the same customer account, the same credit card, and/or orders using the same billing and/or shipping address. If we make a change or cancel an order, we may attempt to notify you by contacting you via the email address and/or billing address/phone number provided at the time of order. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you if necessary.

If, at our sole discretion, we believe that you have failed to comply with any term or provision of these Terms of Service, or we suspect you have, we may also terminate this agreement at any time without notice and you will remain liable for all amounts owed up until the termination date; accordingly, we may deny you access to our Services (or any part thereof).

SECTION 20 - LICENSE

Unless otherwise stated, the various artists featured on the site, each for their respective works, hold the intellectual property rights for all material on HANP, www.hanp.it. All intellectual property rights are reserved. You may access this material from HANP for your personal use subject to restrictions set forth in these terms and conditions. You may not: Publish material from HANP; Sell, rent, or sublicense material from HANP; Reproduce, duplicate, or copy material from HANP; Redistribute content from HANP. This Agreement begins on this date.

SECTION 21 - SHIPPING AND RETURNS

Please read our Shipping and Return Policy, which applies to products purchased from us using the website. Customers within the European Union are entitled to a statutory withdrawal period of fourteen working days. Details of this legal right and an explanation of how to exercise it are available in the Return Policy.

SECTION 22 - ORDERS

Orders can be placed through the website www.hanp.it, accessible 24 hours a day, 7 days a week, or by contacting our staff directly (phone: +39 338 584 1795, email: info@hanp.com). Orders for original (unique) artworks or reproducible products available on the site are automatically considered accepted under the conditions proposed on the site and will be processed after payment is received (for payment by bank transfer, refer to the conditions specified in Section 23 - Payments). Delivery of original artworks usually takes place within 15 working days from payment receipt. Orders for fine-art Giclée prints, on canvas, baryta paper, or other substrates, framed or unframed, are made to order and usually delivered within 30 working days from payment receipt. You will receive a shipping notification once your order is sent to the print provider, and you will be informed of the status of your order. However, you can contact us at any time for an update by sending an email to info@hanp.com. The delivery times stated on the website are always understood as working days (excluding Saturdays), are purely indicative, and are subject to change. The delivery times begin from the moment of payment or when the funds are credited. The times calculated on the product page refer exclusively to the preparation time for the product itself for shipping (delivery by HANP or third parties to the courier) and do not include delivery time (i.e., the actual delivery of the product by the courier to the customer). All shipments are insured and traceable. In the case of international shipments and/or artworks of non-standard size and/or weight, the shipping cost, which is always the responsibility of the customer, may not be visible at the time of purchase. In such cases, we recommend contacting us using our contact details for clarifications and checks before making payment. Within five working days of receiving your order, we will contact you by phone or email to advise and discuss the delivery of your order.

SECTION 23 - PAYMENTS

Customers can make payments using the following methods: credit cards, Shopify Payments, PayPal, Stripe, Apple Pay, bank transfer, or postal money order payable to H.A.N.P. Bank transfer details:

If the payment is made via bank transfer or postal money order, the order will be processed upon receipt of the credit, typically within 2-5 days after the transfer or deposit of the money order (times may vary depending on the financial institution used).

SECTION 24 - CUSTOMS DUTIES

If you are ordering goods to be delivered outside the European Union, please note that your package may be subject to customs duties and taxes, which are applied once the goods reach the destination country. Any taxes related to customs clearance must be borne by you. You agree that HANP has no control over any additional fees related to customs clearance. We recommend that you check with your local customs officials or post office for more information regarding taxes/customs duties that may apply to your online order. Upon your request, we may, but are not obligated to, assist you in understanding such costs. You will be the importer and therefore responsible for any customs duties. Additionally, all costs for customs clearance will be borne by you, the customer. Please note that during the shipping of goods from Italy, shipments may be subject to opening and inspection by customs authorities. For all goods sent to an address outside of Italy, you are considered the importer of the goods and must therefore comply with all the laws and regulations of the country to which the goods are delivered.

SECTION 25 - MINORS

HANP, www.hanp.it, does not sell products for purchase by minors. We sell products that may be purchased by adults on behalf of minors. If you are under 18 or have not reached the age of majority in your state or province of residence, you may only purchase from this website with the involvement of a parent or guardian.

SECTION 26 - EVENTS BEYOND OUR REASONABLE CONTROL

HANP will not be held responsible for any delays or failure to comply with our obligations under these terms if the delay or failure results from causes beyond our reasonable control. This condition does not affect your legal rights.
